Property and Event Policies

We realize you're coming to New Orleans to have a good time and want to keep the house rules as clear and straightforward as possible, but please read them to make sure you understand our expectations and to avoid any surprises. Our property is located in a residential area and out of respect for all of our neighbors we have specific guidelines related to noise, parking, and events (all outlined below). By confirming your booking and paying your required deposit, you are agreeing to all terms outlined below.

We are a licensed bed and breakfast and rent out individual rooms on a nightly basis. On occasion, we can also arrange for a buyout of all eight (8) bedrooms in the main house (though the caretaker’s cottage is not available).  As the primary tenant(s) you agree to abide by all rules, regulations, and guidelines set forth in this document and take responsibility for the actions of all individuals on premises during your stay. You also understand and accept that you are entering into an agreement with Mazant Holdings, LLC for use of the property at 906 Mazant Street, New Orleans, Louisiana, 70117 for the dates reserved online.  Please verify the accuracy of your reservation dates and total cost before signing this contract.

Property Policies

By confirming your booking and paying the required deposit directly or through a third-party service, you are agreeing to all terms in this contract.

As the primary tenant(s) you agree to abide by all rules, regulations, and guidelines set forth in this document and take responsibility for the actions of all individuals on premises during your stay. You also understand and accept that you are entering into a vacation rental agreement with Mazant Holdings, LLC for use of the property at 906 Mazant Street, New Orleans, Louisiana, 70117 for the dates reserved online.

  1. CHECK IN AND CHECK OUT:  Early check in and late check out is by prior approval only. We do our best to accommodate these requests, but we often have guests checking in and out on the same day so we cannot guarantee any exceptions until a week prior to arrival. 

    1. Check In time is 4:00pm Central Time on the first day of your reservation.  

    2. Check Out time is 11:00am Central Time on the last day of your reservation.

    3. There is no fee for advanced, approved late check outs, but unapproved late check outs will be charged at $250 per hour, or fraction thereof.  Check out includes fully vacating the premises, including all vendor/event equipment that may have been delivered on site.

  2. PAYMENT: To make things easy for our guests, we can accept direct bookings or those through third party sites (e.g. Airbnb, VRBO, HomeAway).  The payment terms and details may differ depending on booking source, so please refer to each platform for specifics.  In the event there is any ambiguity, this agreement will default to the stricter payment terms and requirements.

    1. Third Party Sites: Payment for reservations made through third party sites (e.g. Airbnb, VRBO, HomeAway) will be handled according to the policies and schedules of the given platform.  All payments must be received at least seven (7) days prior to check in date and are non-refundable after that time.  

    2. Direct Bookings:  A deposit of fifty percent (50%) of the agreed rental amount is due at time of booking and the balance is due sixty (60) days before arrival. The advance payment is not a damage deposit and this money will be applied toward the total rental amount. As noted below, a separate $1,000 refundable damage deposit is due sixty (60) days prior to arrival and will be refunded - assuming no damage or violation of house rules - within fourteen (14) days after departure.  Payment can be online through personal check or credit card via a link provided at time of reservation confirmation.  The balance of rent is due sixty (60) days before your arrival date or sooner to confirm your booking.  If the balance is not received at least sixty (60) days prior to arrival, you will forfeit your reservation and the space may be opened up for another group - with no refunds of any payments previously made.

  3. DAMAGE/RESERVATION DEPOSIT: In addition to the rental fees, we require a $1,000 damage deposit.  This is due no later than sixty (60) days before arrival.  The deposit is NOT applied toward rent; however, it is fully refundable within (14) days of departure, provided the following provisions are met:

    1. No damage is done to the property or its contents, beyond normal wear and tear.

    2. No charges are incurred due to contraband, pets, or collection of rents or services rendered during the stay.

    3. All debris, rubbish and discards are placed in refuse containers outside, and soiled dishes are placed in the dishwashers and started.

    4. No need to start laundry.

    5. No linens are lost or damaged.

    6. No early check in or late check out unless prior approval was received.

  4. CANCELLATIONS: All cancellations will incur a minimum five percent (5%) fee, with schedule as follows: 

    1. Greater than 90 days prior to stay: full refund, less five percent (5%) of total rental fee or $50 (whichever is greater). 

    2. Fewer than 90 days prior to stay: no refund and forfeiture of all funds paid.

    3. To protect yourself against potential cancellations from illness, death, or other unforeseen events that may impact your party, we strongly encourage you to purchase travel insurance.

  5. MINIMUM AGE: The minimum rental age is 25 years old, unless accompanied by a parent or guardian.

  6. MAXIMUM OCCUPANCY: The maximum sleeping occupancy of the main house is 18 people.  If you have more than 18 people sleeping on site, you will be charged $200 per person, per night - unless you have prior written approval allowing more guests.  

  7. FLOOR PLAN/LAYOUT: We reserve the right to make modifications to the number and size/type of beds without notice - as long as overall sleeping capacity and number of bedrooms does not change. If sleeping capacity and/or total number of bedrooms changes, tenant shall have the option to cancel in full without penalty/cancellation fee.

  8. COTTAGE: Unless otherwise stated, the cottage is not included as part of the rental and is occupied by our onsite caretaker.  Please inquire if you are interested in renting it.

  9. NON-SMOKING: This is a NON-SMOKING home.  Smoking is only allowed outdoors in designated areas.  If you smoke indoors, there will be an additional cleaning fee of $1,000.

  10. PETS: Pets are only permitted with prior approval. Pet owners are responsible for cleaning up of any/all pet refuse. Pets are not allowed on furniture at any time. Any evidence of pets on furniture may incur extra cleaning fees. All pets must be up-to-date on rabies vaccinations and all other vaccinations. Heartworm preventive medicine is highly recommended. All pets are to be treated with Advantage or similar topical flea and tick repellent three (3) days prior to arrival. Fleas and ticks are very rampant in this area and can cause harmful/fatal illness to humans and pets. All items above are the sole responsibility of the pet owner. The property owners assume no responsibility for illness or injury that may occur to pets or humans while on the premises.

  11. HOUSEHOLD SUPPLIES: The house will come with an initial supply of hand soap, dishwashing detergent, laundry detergent, paper towels, toilet paper, and garbage bags. Additionally a variety of spices and cooking ingredients may be available for tenant’s use. All other household and cooking supplies needed shall be the responsibility of the tenant.

  12. PARTIES AND EVENTS: While we do allow events on site (subject to an additional fee and agreement), there shall not be any house parties, weddings, receptions, or other events on the premises without express, prior written approval and acceptance of a signed event contract.  If you violate this rule, you will face immediate eviction and loss of all rental payments as well as the security deposit. 

  13. NOISE: The house is in a residential neighborhood and we do our best to be respectful of our neighbors. As such, we do not allow outdoor amplified music or any other loud noise between the hours of 9:00pm and 7:00am Central time.  We have decibel meters installed throughout the property and are notified should outdoor noise levels exceed reasonable limits.  If the police are called, there will be a minimum of $1,000 deducted from the security deposit.

    1. Party Buses: Due to past issues and out of respect for our neighbors, we do not allow pick-ups or drop-offs by any bus, large van, trailer, or other “party bus”-like vehicle.  We may make exceptions for some daytime events, but only with prior written approval.  Violations of this rule will result in a minimum of $500 being deducted from the security deposit.

  14. TOWELS AND LINENS: Rates include a one-time linen-towel setup. Unless agreed upon prior to the stay, subsequent towel and linen services will be at the cost of the tenant(s).

  15. CLEANING: Tenant(s) agree to keep the property clean and safe throughout the duration of their stay.  

    1. Daily Maid Service: While linens and bath towels are included, daily maid service is not included in the rental rate.  It may be available for an additional fee by request.

    2. Excessive Cleaning: In the event the property is left exceptionally dirty, as determined by the property manager and/or owner(s), a minimum additional fee of $250 shall be charged.

    3. Garbage: No junk or garbage will be allowed to accumulate on or near the premises. All garbage shall be promptly sealed in plastic garbage bags to help prevent odors and insects.  In the event excess garbage is left inside the house or not properly disposed of in the trash cans, there will be an additional fee of at least $100.

  16. POOL AND SPA: The property has a pool and spa (both heated) - which if used improperly or unsafely can pose a serious risk to all guests.  You agree to follow standard safety procedures and all instructions. You also agree that no glassware is allowed near the pool and that you must use only plastic cups (available in the kitchen) when near or in the pool.  If glass is found in the pool after your stay a minimum $500 fee will apply.

  17. PARKING: Parking is limited to two (2) vehicles on site.  There is generally ample street parking on Mazant and Burgundy Streets.  If you have more than ten (10) cars, you should strongly consider a private lot.  Additional parking is available in the lot at Crescent Park (approximately three blocks away).  Vehicles are to be parked in designated parking areas only. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.

  18. WEATHER CONDITIONS: No refunds will be given for storms or cancelled flights.  Severe wind and rain do occur in the Greater New Orleans area, but we do not refund due to weather conditions.  You may want to consider purchasing travel insurance (e.g. www.insuremytrip.com) that protects against inclement weather.

  19. PROPERTY MANAGER:  The owners are generally not on site, but there is a local property manager who lives nearby and can answer any questions or assist with issues that may arise during your stay. The property manager’s phone number is located on the welcome card inside the house. Please notify the property manager of any damage or other issues prior to check out.

  20. RATE CHANGES: Until a reservation is confirmed and initial deposit fully paid, all rates are subject to change without notice.  

  21. FALSIFIED RESERVATIONS: Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit, and/or rental money, and the party will not be permitted to check in.

  22. WRITTEN EXCEPTIONS:  Any exceptions to the above mentioned policies must be approved in writing prior to the beginning of the stay.

  23. PROPERTY CLOSURE:  Though we do our best to plan any repair, maintenance, renovation, or restoration work when we don’t have guests.  Occasionally, through events out of our control, the property must be shut down and taken offline.  As a result, in rare circumstances, your reservation may need to be cancelled and/or adjusted to accommodate such work.  Whenever possible, we will give you as much advance notice as we can, and in the event that we do cancel your reservation will offer a full refund of any fees paid.  That said, we are not responsible for any charges, fees, or other costs that result due to such a cancellation - including those to 3rd party vendors or airlines. We encourage you to investigate purchasing event or travel insurance to cover such circumstances.

  24. NO LIABILITY/INDEMNIFICATION/HOLD HARMLESS: The owners of the property and Mazant Holdings, LLC do not assume liability for the loss, theft, damage, or injury (or death) to persons or their personal property. Tenant(s) agree to indemnify and hold the owners and their representatives harmless for any liabilities, including owner’s negligence, theft, damage, cost, or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with tenant’s use and occupancy of the rental property, including but not limited to claims for personal injury or property damage/loss.

By confirming my booking and paying the required deposit either directly or through HomeAway, VRBO, Tripadvisor, or any other similar service, I/we agree to all terms and conditions of this agreement. This is the entire Agreement between the Parties.

Event Policies

WHEREAS, Lessor is the owner of certain improved real property located at 906 Mazant Street, New Orleans, Louisiana 70117 (“Premises”) and herein referred to as “The Mazant” and WHEREAS, Lessee desires to rent said Premises for a wedding (“Event”) and WHEREAS, Lessor is willing to rent a portion of said Premises as set forth below. WITNESSETH; That for and in consideration of the payment of rents and the performance of the covenants contained on the part of Lessee, said Lessor does hereby demise and let unto the Lessee, and Lessee hires from Lessor for use as an Event Location the portion of the Premises as hereinafter set forth.

  1. USE GUIDELINES

    1. PROOF OF LIABILITY INSURANCE: Lessees shall obtain a single event liability insurance policy, with a minimum liability limit of Two Million Dollars ($2,000,000), naming Lessor as additional insured and loss payee, within 30 days prior to the Event. If a certificate of insurance reflecting Lessor’s additional insured status is not provided to Lessor by Lessee within 30 days prior to the Event, Lessor reserves the right to cancel the Event.

    2. TIME OF ACCESS: The Event rental of the Premises shall not extend beyond 9:00 pm. The premises are located in a residential area and the Event must end by 9:00 pm on Friday or Saturday and 8:30pm on all other days; all non-resident guests shall vacate the property no later than the end time. Access for setup is also available to rental companies on the day before the Event. Further, Lessee shall use the exterior of the Premises only for the Event as described above and for no other purpose without the Lessor’s prior written consent. Any required/desired outdoor lighting must be provided by Lessee. Lessor accepts no liability for any accidents or damage that may occur because of poor lighting.  Lessee is responsible for closing and locking all of the doors at the end of the Event, and ensuring the property is adequately secured.

    3. EVENT PLAN: Lessees shall submit an event plan outlining location of all tents, seating, dance floor, music, and other modifications to the property for review/approval at least sixty (60) days prior to arrival.

    4. GUEST COUNT: The number of attendees at the Event shall not exceed that agreed upon as part of the initial quote/contract for the specified fee. Guests beyond the original number may result in additional charges.  At no time shall the total number of guests on the property exceed 200 persons. Access to the upstairs interior of the main house is limited to only the bridal party, immediate family, and guests staying at The Mazant. Specific exceptions to the above include access for elderly individuals in need of interior amenities for health purposes. Other attendees’ use is limited to interior, downstairs public and outside areas of the Premises and all non-resident guests shall vacate the property by 9:00pm.

    5. MUSIC: Live music with amplification is not allowed.  Live music without amplification (e.g. harpist, jazz quartet) as well as DJs or similar setups are allowed with prior written approval only.  All music must adhere to local laws, regulations, and ordinances governing volume and length; the property manager has sole discretion in determining volume levels.  Music violating these limits will be shut down by Owner or Owner’s representative.

    6. CANCELLATIONS: All cancellations will incur a minimum five percent (5%) fee, with schedule as follows:

      2. Fewer than 90 days prior to stay: no refund and forfeiture of all funds paid.

    7. SMOKING: No smoking shall occur inside the house.  Smoking is only allowed in designated areas to the exterior of the house.  Any smoke damage will result in a minimum $1,000 supplemental cleaning fee.

    8. ALCOHOL: Lessee shall not violate any city ordinance or state law in or about said Premises, including, but not limited to, laws relating to the minimum age for alcohol consumption.

    9. RESTROOMS: There are three (3) downstairs restrooms available to guests. 

    10. PARKING: Parking on the Premises is limited to rental guests and vendors only.  Parking is limited to two (2) vehicles on site.  To avoid neighborhood congestion, any events with more than ten (10) vehicles must secure a shuttle or reserve a dedicated parking lot (such as Crescent Park).  Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.

    11. DANCE FLOOR: Dance floors are not required as all dancing must take place on the patio near the pool.

    12. CATERERS/VENDORS: Lessee is responsible for providing and supervising caterers and all other vendors. Caterers are allowed access to the running water in the kitchen. The caterers are responsible for the cleanup of all food materials and garbage. It must be taken with them at the end of the Event or a dumpster must be rented.  All caterers/vendors must complete load in and load out during standard business hours and must not disturb the neighborhood residents by loading or unloading during the hours of 10:00pm and 7:00am.  All materials must be picked up prior to check out; any late pickup of materials will be subject to $500 per day minimum fee.

    13. PROPERTY APPEARANCE: Lessor makes every effort to maintain the Event site and grounds in an orderly and attractive manner. However, we make no guarantee for the exact appearance of any landscape at any given time. Planting, mowing and maintenance schedules are all subject to weather. Every attempt will be made however, to keep the gardens and property looking their best for the Event.

    14. DECORATIONS: Altering or customizing any part of the Premises for the Event is not permitted without express written consent prior to the Event by the Lessor. No material may be attached, affixed, floated, tacked, stapled or taped on the walls, doors or any party of the interior or exterior. No bird seed or rice is allowed to be thrown on the Premises. Real flower petals may be used in small quantities. Others decoration alternatives must be submitted to and approved by Lessor.

    15. SECURITY: All events with more than fifty (50) people require at least one (1) security officer on site, approved by Lessor for the duration of the event.  For any events greater than 100 people, Lessee agrees to hire at least two (2) security guards approved by Lessor for the duration of the event.  Events larger than 150 people, require three (3) security guards, approved by Lessor. Lessor can recommend an approved company, but it is the responsibility of the Lessee to secure and pay for the firm.  Approximate cost is $30 per officer per hour, but is subject to change at the discretion of individual vendor(s); officer(s) must be on site for entire event, plus at least one hour prior to and after event.

    16. CLEANING: Fee paid by Lessee includes basic cleaning services following the event, however It is the responsibility of the Lessee and their vendors to restore the Premises to the condition it was in prior to the Event. This includes, but is not limited to, light cleaning and garbage removal. All food, decorations, garbage and other personal articles must be removed by designated check-out (or an agreed upon time between Lessor/Lessee) the following day of the Event. Any excessive cleaning or maintenance work will be deducted from the security deposit.

    17. TENTING: Unless otherwise approved in writing, no tents are allowed in the oak tree (cottage side) corner lot.  Prior approval for any tent(s) is required and additional fee may be charged to cover the permitting approval process.  All tents must be fire retardant pursuant to local laws and regulations.  To ensure adequate time for necessary permits, all tenting requests must be submitted at least sixty (60) days before the event.  Requests with less than sixty (60) days notice may be unable to use a tent onsite.

    18. CHILDREN: Children are welcome on the Premises; however, it is the Lessee’s responsibility to see that they are supervised at all times.

    19. LESSOR REPRESENTATIVE: A representative of the Lessor may be on-site during the Event to monitor the Event and to assure that rules are being followed. The representative is not there to police you or your guests, or to run or manage your Event.

    20. PHOTO & VIDEO USE: Occasionally, we may take photos and/or videos during the setup, take down, or the actual event. These images will remain the property of Mazant Holdings, LLC. All ownership (including copyright) as well as all other rights, title, and interest in and to these recordings shall belong exclusively to Mazant Holdings, LLC and the producing company and may be used for advertising The Mazant.

    EVENT RENTAL AGREEMENT VALIDITY/NULLIFICATION

    This Event Rental Agreement for the Premises will only be held a valid, viable and legal instrument with a coexisting, fully executed, and valid Property Rental Agreement. If no such contract exists, then the Lessor is not legally obligated to fulfill their contractual provisions stated in this contract and the Lessee cannot bring suit, commence arbitration, or hire an attorney to compel performance of or to recover for breach of any covenant, agreement or condition contained in this Event Rental Agreement.

    HOLD HARMLESS AND INDEMNIFICATION

    Lessee agrees to hold harmless and indemnify Lessor, Lessor’s agents, employees, partners, members, heirs and anyone else acting on Lessor’s behalf, from any and all claims, lawsuits, causes of action, damages, judgments, attorney’s fees and court costs, any other liabilities whether asserted at law or in equity, that arise out of or relate in any way to the acts or omissions of Lessee, Lessee’s agents, independent contractors, service providers, quests and/or anyone else acting on behalf of Lessee or the Event, whether or not such actions or omissions occur with Lessee’s consent. It is the intent of this paragraph that Lessee is fully responsible for any damages that relate to or result from Lessee’s use of the Premises for the Event.

    GOVERNING LAW

    This Agreement is governed by the laws of the State of Louisiana, and nothing contained herein shall be construed as waiving or limiting any and all of Lessor’s rights under the Laws of the State of Louisiana.

    DISPUTES

    If any legal action is necessary to enforce the terms of this contract, the prevailing party shall be entitled to reasonable attorney’s fees and costs in addition to any other relief to which the party may be entitled. The parties agree that the venue for any action related to this contract shall be Orleans Parish, Louisiana.

    ACKNOWLEDGEMENT

    Lessee acknowledges that he/she has read and understood all of the terms of this Event Agreement and agrees to abide by them. Lessee further acknowledges and represents that, as required, he/she will advise all attendees of the rules contained in herein.
